That is why the DAFT errr DAFF people have started procedings... Im sure they dont know where they stand so they just making sure about everything.
 
As I said, I am also a german down here on a work permit, and I disagree with the entire "If you don't like it, leave story". I may not be South African, but I am fiercly proud of my adopted country (propably more so than my home country), I have a child on the way who will be South African rather than german, and as I pay taxes etc just like everyone else, I reserve the right to bitch and moan when things such as the situation Marcel is in crop up, or pot-holes in the street, or corruption etc. There are lots of foreigners here in ZA that add a ton of value to the country, and just for the fact that their paperwork is different, doesn't mean that they are not allowed to voice any criticism. I do not disagree with the fact that the laws of the country you reside in MUST be adhered however, but from what I can see in the thread, it's hardly a clear-cut case like driving drunk or evading tax for example. Leave the "don't like it, leave" stuff to the politicians.

Anyhow, back on subject. I understand you dislike having a partner in your business. Are you maybe married or have a Girlfriend of SA origin? There are a lot of options available to you in terms of SME finance that you could maybe explore in that case, the DTI in Pretoria is a good place to start. To get finance without a Permanent residence will be VERY difficult if you want to deal with anyone but private individuals, ie a Partner, and you may possibly arrive at the point where you will need to concede a bit on this.

In order to get yourself set up with someone like the DTI, your documents, especially a Business plan will have to be spot-on, and I'll be perfectly honest, if you can figure out a way to uplift even just one or two previously disadvantaged people by employing & training them, you'll stand a much better chance of obtaining some finance at very reasonable interest rates. And you'll get the satisfaction of helping some people with fewer opportunities than many others out as well, which is a very nice feeling.

In terms of the Partner story, you must also maybe consider that not all partners are the same, as they are all just people at the end of the day, so one bad experience shouldn't make you now say that all partnerships are bad, maybe it was just a bad partner, or a bad fit? And also consider that a South African partner isn't to be just a source of finance for you to do your own thing, but maybe can add some value to what you want to do? A good example would be someone with an interest in the Marine hobby who has a clue about Finance, Contracts and the Law, who can do that side of the work safely and honestly (as they have money invested) leaving you to do what you actually WANT to do, which is breeding fish? We have fallen on our face opening a business in South Africa a long time ago due to people cheating us in a partnership, lost lots of money and had to close shop; Since then we have found the right partners who employed financial people with administrative brains (which we lack, we are operational / marketing people), and our company is going from strength to strength, ie both parties are getting value from our arrangement for many years now. Just some food for thought, and although I disagree with the "Shut up or get out" comments, maybe another thing to consider is that sharing your clearly considerable and rare skills with some citizens of your host country is something to aim for as well, give something back to South Africa, after all, it's a much nicer place to live in than Germany IMO, and knowledge / skills is what is needed desperately here.

Marcel I find it interesting that you are keen to find a financial partner in your venture. This needs alot more discussing but if you are able to pull through this drama and still be able to continue with the breeding and distribution of the Albino's in SA then I would be keen to look at a share deal in your company ie become a partner.

I even find it more interesting where you have read that. I am not taking anybody as my partner into this business. If someone wants to come up with some cash to help me, I offer a decent interest rate for the period. Maybe a livestock bonus or something. If someone might be worth to be my partner, then it will be the person that is running the future hatchery like I do and I would, if I'm not present. I only need a bit cash until I can start selling. Bridge financing is needed. Have a meeting with a banker on Wednesday. Hopefully no need for funding my legal rep.

"these admins" are simply implementing the rules you and everyone else agreed to when joining the forum. We will not tolerate ANY mud slinging of people or the other forum. this is NOT a platform for personal attacks. this thread has been reported several times by various members concerned about the way it is heading

most sites would have simply deleted this thread yet despite it going south on more than one occasion instead of deleting it we have removed the offensive comments and let the thread carry on, a lot of the thread in direct and vocal support of your cause LuckyFish.

I agree with you to keep things clean. My post about the annoying admins is the perfect example why things get taken up the wrong way. Writing something without seeing the impression on the writing persons face can lead to misunderstandings. I posted this via my Iphone and it is a PITA to add smilies from there.
Replies to people who know each other will be understood between them, but others will read things as offensive posts. Sometimes I would make more sense to add smilies while editing by admins, instead of deleting the posts.

Hope this explains it a bit.

Guys well done on keeping this thread clean instead of deleting it!I really hate it when mods on forums get lazy to filter out too offensive content and rather just lock the whole thread.

i contacted carte blanche, mail and guardian, premier of western cape, cape talk all on thursday. lets see if they do anything. ps alan would you be willing to set up an account to deposit the 'legal fish' donations into for those who are willing to make donations that have no strings to help with luckyfishes legal costs and if we have any change we can donate it to some charity?

We are fully behind a good cause and although i dont fully understand the law as it stands, i do believe Marcel has a case. This will have to be discussed amoungst the staff but personally i really dont think any of us are in a position to administer such an account, with having full time jobs and the forum to run i dont really think we could do it. IMO, If such a fund were set up it would certainly have our full support as far as advertising etc, lets see what happens next week.
 
I agree with Alan. Let's first what the lawyer says and then what the banker says. I might be sorted out until the end of this month. I got a good feeling with the lawyer and the banker. Cant wait until Wednesday evening.

From how I understand this law, any fish processing establishment will need a permit.
Any Fish and Chips shop is a fish processing establishment.

The last act is about collecting from our waters and all south african waters are protected. If u read the full section it puts it into context. When importers sell fish to petshops the permit from SARS clears the fish as they are caught outside of SA waters and it then filters down to the lfs and then the reefer.

interesting, your Fishing permit allow collecting local fish for own use and Marine Fishkeeping, while using respiratory devices. Illegal to spear fish while using respiratory devices. Must find that clause.
