I mentioned it before, if a lawyer does the talking, things that should be said, won't be said in court. Who knows the whole story better than me!
And to be honest, I am not so sure if I really have to go to court on the 7th. Lots of time until then, and from my point of view, DAFF should solve this matter together with me before it goes to court. It might be, that the big boss of DAFF totally disagrees with what happened.
DAFF knows everything I did so far, because I told them so. So why not working together to find a solution?


Well my oppinion and experiance is that they will most certainly have an advocate to rep them and then you have a judge, which means that Marcel you would be the odd one out as judges and advocates speak a very different language that you will get lost in and this will affect you chances in na huge way.

Yes you are the best one to give your version of the facts but believe me when they are quoting legal terms you will be trying to figure out what they said 10 min after its been said that will happen. And when it comes to you presenting you case you will be so lost and confused that you will not do a good job. This they have done to create a Niche enviromennt which makes any normal person need the services of 1st an attorney and 2nd an advocate.
 
Exactly trev. No point having all the facts in your head if you cant speak the right language (and a few times in the past Ive seen Marcel say hes german and so we must forgive his language). And your lawyer should be fully briefed by youso should be able to lay out the facts in the right manner.
 
especially since some cases can use multiple languages depending on who is involved.

But that is exactly the point. If the judge, their and my lawyer speak in their advocate language, I wouldn't understand what the hell is going on.
So rather I do it myself. I know the Marine life resources act in and out, so I don't see a problem to defend myself better than a lawyer would do.
They will throw the case out in anyway, as they looked me up for the wrong reason in the first place.

BTW, my english is much better, than it was. So I really doubt, I would get lost in court.

Hi LuckyFish. We don't want to loose you because its one of my dreams to come and visit you one day.
Get your paperwork sorted. Even if it means to go and park in a few different offices or get a SA partner if it seems impossible. I am sure you are working on it. Keep us posted and how long have you sat in a office and your experience of the clerks, etc.

But then, the judge and their lawyer will still speak their advocate language... so either you will not understand "what the hell is going on" or you wont "get lost in court"... but contradictory there?

And the only reason Im going on about this is I honestly think that having an attorney on your side will offer you the best opportunity for success.

Please listen to everyone telling you to get a lawyer. Even if they speak in their advocate language, they will have to translate it for you don't they? Ask at the German consulate about it.

You might know the act inside and out, but if you cannot understand the way they ask you a question or the way they might pharse that question, they can twist your answer around. A lawyer will have your best interest at heart and not allow his emotions to get in the way. Please just think about it.

On another note, I was thinking of linking this to some other sites. But I think you should do it.

I know it would be of great interest on RC and depending on which state they are from, you will get different responses.

Funny in the states each state have their own set of laws on what you are allow and not allow to keep. Is that the same in South Africa?

I think you should appoint an Attorney. most people do not realise or understand the process through which a criminal matter goes...often, persons who represent themselves do not apply the law properly..you must remember there are many laws at play during court procedure ( Crim Procedure act, Constitution etc), not only the specific law you are being charged under. it might cost you a few thousand rand, but might keep you in SA.

as explained earlier, sometimes the police officers just put a simplified version of the charge on the charge sheet..the prosecutor will read out the full charge at trial, should the matter ever go to trial
 
At this stage, I have to say a big thank you for your support, guys. There is some light at the end of the tunnel. I just spoke to the general director of DAFF. I asked him for a meeting to get the record straight. He will first listen to the investigators side and he will then meet me. I am sure together, we can solve this matter as I believe there is a big misunderstanding or false accusation on the go.

Will keep you guys informed. And still, I am going without a lawyer. Put a bit trust in me, I am much more clever than you guys think I am. I could have taken the governments lawyer free of charge, but in this case, I only trust myself.

Have faith in me!

No disrespect but no matter how cleaver you are you will not be able to represent yourself properly without a lawyer if you have not studied law yourself. I'm an engineer and my brother is a lawyer and half the time I have no idea what he is saying. Law is a whole different language.

This is wonderful news Marcel! I hope the charges are dropped and you can get your mind back to marines!

yup plumbers are always in the crap! always in hot water ,! fiddle with old geysers in the dark ,and always havethe plug pulled on you when you least expect it!
