Like all court cases in SA, its going to be pospened. Marcel, make use of this month or two to get your license. Even if it means that you have to sit day and night in there office, maybe with some international media. Wake them up, tell them tea time is over.
This whole story is going to make you mega world famous. You won't be able to keep up with orders streaming in.
 
Good luck today Marcel! I just want to double check if I'm understanding this correctly. According to the "Notice of rights in terms of the constitution", it says you are being detained for "Possession of marine species without a permit". It doesn't say anything about "breeding". Am I missing something?

That is the point. Locked up for the wrong reason.

I'd also like to add a word of caution, it is clear and obvious that you have been proceding in an open and transparent manner, and in full consultation with the authorities. While the law is clearly poorly written and there's a bit of greyness here - that should be your strongest defence. Best of luck Marcel.

And why no lawyer? Surely its worth getting a specialist in considering whats at risK?

For what do I need a lawyer? I know my rights and I know the Marine Life Resource Act.
If a lawyer does the talking, then things never get said, that should get said.
Besides that, I don't have the cash for a lawyer.
 
Unbeliveable, I know a good lawyer in Parow that doesnt really charge anything for a consult and if you want legal letters sent, PM me if u need details. Good luck with the fight buddy
 
I phoned the DAFF and nobody want to make any comment to what has happened yesterday. I was told to talk to the head of the DAFF, he will be back probably by coming Monday. They were also considering to transport the fish, which means confiscating.
So I am going to get the German Embassy involved to protect my "pets".
 
Marcel, I am a bit confused now. Can you please explain why you cannot hand in the permit application?

If confiscating were to happen, who would care for the fish? Where would they go?

I'm wondering if someone out there isn't trying to take your fish away to breed themselves with the hopes of making a huge profit.
 
Brenda, I think this is just a case of poorly developed legislation being misused. South Africa has a globally recognised consitution, but so so so much work needs to be done on the finer legislation its not even funny. There are holes and grey areas everywhere.

I understand that but there was a WHOLE lot of effort focused on just one person. Money seems to be the reason for just about everything. Marcel has something that nobody else in the world has, that could (and should) be higly profitable. There are other's breeding fish and other marine life that are not being targeted.

Somebody spent a lot of time and money here. It is not free to send 8 officials over to Marcels to haul him off to jail. Surely there are others involved besides these 8 that approved the arrest. There are also court costs for the other side as well. What is the motive?

Brenda there are no facilities to my knowledge that can hold the fish and if so i doubt anyone with passion will be doing this?

it may go to an aquarium if anything were to transpire.

i know of a case where someone was caught for bringing a snake (anoconda) into the country ilegally it was taken to the petshop for safe keeping and basically forgotten there. they did not pay for food nor any type of upkeep which brings me to ask why not just let the person who wanted it origionally keep it. surely better care would have been give to it by somone who had a passion for it.

and this in its self should have been seen as a crime..
