Legal advice wanted please.

    Afternoon fellow reefers ... to cut a long story short, i rented out my house, gave the tenanat notice, and now found out, he didnt pay water and lights for a VERY, VERY long time.

    I also now found out, that as per the legal agreement with the water and light department, any outstanding debt will become the home owners issue at the end of the day.

    I want to sue this guy till kingdom come, really !

    If anyone is in the legal sector, please pm me.

    nasty one - should have checked that from time to time. sadley it will cost you more money to try get your money back which in most cases is not worth it.

    Zero , before moving to CT I spoke to Tswane Municipality as I am renting my property in PTA. The guys are correct , the account remains the responsibility of the person who has the contract with the municipality ( normally homeowner). However if your lease agreement states that it was the tennants responsibility you do have a case against him You will however have to settle the account first with the municipality yourself

    frans is 100% correct.
    you starting off the case on your back foot, unless you have a mate who's a lawyer to help you out,.......its gonna cost a packet with no guarantee og getting anything back:(

    i have a great lawyer if you need

    Well, to cut the story short, I am a nice landlord ...

    Well, i made a list of all defects when i got the house back, and the tenant now swears it isnt him.

    Well, regarding the water and lights, it is a huge amount, R7200. He also owe's me R2500 in short payments.

    I went to see the agency who placed him yesterday, and i couldnt tell them about the bad stuff, because i only found out after i got the house back.

    Well, i am also chatting to TPN regarding black listing him.

    Honestly, wish people will be more honest and fair, wouldnt life be much better and enjoyable then ?

    What the scary part is, i found out that the tenant i had, is owing the water and lights department R4000 from where he rented before me. Now, that is scary !!!

    The Agency who placed him for you was supposed to do reference and credit checks on him. You should hold them responsible for this. Also, his entire deposit should be given to you in full to cover some of the bills and fixing any problems in the house.

    Well, the agency phoned me, and i said there isnt anything like the perfect tenant, everyone has its ups and downs. Well, I later found out about the water and lights bill.

    This is really sad. I am currently chatting to the TPN people, ITC for tenants ...

    Make sure they pay his entire deposit to you. He shouldn't get a cent back.

    Well, the plan of action so far is, he owe me R3000 for damages and short payments. If he pays me that, I will refund his deposit and pay it off towards the water and lights bill.

    I think i am very fair ! So, i wait for his bit first.

    What amazes me is that tenants always seem to be months in arrears with L & W and yet if you dont pay immediately, they come and disconnect it. I suppose you can count yourself lucky as I believe that you may not evict a tenant either. Anyway I wish you luck.

    What amazes me about this whole story, any landlord always find stuff out afterwards.

    Example, where the tenant rented, the water and lights was also on his name, and he left leaving the landlord with a bill of R4K. And that is 3 years back.

    He opened a new account on his name, doing the same to me, leaving debt of R7250

    Honestly, and i saw statements where he didnt pay for 9 months, and didnt got disconnected.

    I cant believe it, I think it might be because my rates and taxes are always up to date.

    I also have a plan b, i found a company that does crediting for tenants, and if they dont pay, you pay something like R50, and get them black listed on all credit institutions.

    That would be priceless if he gets blacklisted !
