Dan, you'll have to put yours in and adjust the outlet pipe accordingly. My TS2 is about 35cm deep, the water level comes just level with the top of the REEFTEK label and it works great.

The Label is a good indication of where it need to lie. Most of them that i have seen including my TS1 lie in the middle of the ReefTek Sign.

well my water level at the moment is just under that black ring, that piece what u can remove under the cup, not sure what its called, its not overflowing, but from the looks of it it seems like its much 2 deep compared 2 everyone else, im guessing theres no factory default height setting for this skimmer?

The best way to set the skimmer is to raise it and have the water level no more than 5cms above the pump.
