Fed-up with landlord - advice needed

    Hi

    I am so frustrated and at the end of my tether with our landlord.:m30:

    Our public toilets and amenities in the center have not been attended to for the past few years and it is now at the point you (our customers) are complaining as you can not use the toilets :( I do not know how to handle it?

    I just get loads of promises on a weekly basis for the past few months already from the landlord, but no actions and I can not leave it there anymore. Pietie and Tiny from http://www.acceleratepf.co.za just point the finger at each other and blame the other. One week Pietie state Tiny did not approve the funds and Tiny counter it was approved and Pietie should have done it, then a week later when they are together suddenly there was this or that problem and so it is going on for more than 3 months now.

    Is there anyone out there that can advice me as to legal steps we as tenants can take and who can represent us?:m83:

    Problem is these laws are for renting to live in not business premises. Then this law do not apply AT ALL :(

    Agree with that. Rental Housing act doesn't really apply to big commercial rentals like yours.

    Generally first point of call is what the rental contract stipulates, and who it puts the burden on to maintain. So check that out.

    Further I'd recommend sending out a letter demanding that the lessor act to remedy any failure to perform on his part and give a reasonable period for him to perform thereby and in the event that he fails to perform warn that legal action will be followed up with. In my experience that helps to scare them into acting and also will be the first thing a lawyer will do for you.

    Then secondly if they don't perform go to a lawyer and get further help, nice thing is that I'm sure this doesn't affect you only as the only lessee in the complex maybe together they will be willing to contribute towards legal fees?

    Surely there is a law abouy public toilets. Why welse would they install them in big malls. They take up retal space

    Technically they not public property, they serve a public function but still private property and the owner can do what they will with them, to some extent

    Moolis if it's so bad try and call the health department, Don't really know how it looks like so difficult to say.

    this is a commercial venture, therefore the CPA covers you as there is a monetary trade

    Phoned them and was informed this is not part of their mandate as it is business to business.

    Consumer is a individual not a business

    Burden is theirs as they charge a monthly fee on top of rental PLUS contract stipulate this as well.
    So this raise another question. Where does this moneys go????:m79:

    Letter done ;) asking both the question above and notice to remedy it.

    Lo and behold - LESS THAN 1 day after this thread they started on the bathrooms. It still need detailed finishing but atleast it look better AND IT WORK!!!

    To the 3 marine customers that had to endure my confrontation with the landlord's representative yesterday afternoon, I am sorry for giving them a CLEAR PIECE OF MY MIND IN FRONT OF YOU but this was needed and took 8 months of empty promises to get me to this point.

    If you think about it, they own some really great shopping centers (look it up on their website), they would not dare behave in the same manner in those centers AND they are on the stock exchange, what would their shareholders say. I would not invest in their shares!!!

    Tenant meeting with landlord being scheduled now. Lets see if they even have the guts to face the tenants?

    No - but he told me a birdy informed him, I think it is a co-worker or a boss that is a member.
    To this member THANK YOU I O U !!

    Now we only need to get through this tenant meeting so we can start building on a healthy relationship again.
